These Terms and Conditions (hereinafter, 'Terms') govern the use of the real estate crowdlending platform operated by Guía Transparente S.A. By accessing or using our services, you accept these Terms in their entirety.
1. Definitions
'Platform' refers to the guiatransparente.com website and any associated mobile application. 'User' is any person who accesses the Platform. 'Investor' is a User who participates in investment opportunities. 'Project' refers to each real estate crowdlending opportunity available.
2. Investment requirements
To invest through our Platform you must: be over 18 years old, have tax residence in Argentina or an authorized country, complete the identity verification process (KYC), provide truthful financial information to determine your investor profile, accept the inherent risks of investments in real estate crowdlending.
3. Investment risks
Real estate crowdlending carries significant risks, including: partial or total loss of invested capital, illiquidity of the investment during the project term, delays in project completion, adverse changes in the real estate market. Past returns do not guarantee future performance. Only invest capital you can afford to lose.
4. Investment process
When investing in a Project: you receive a proportional share in the project's profits, you accept the specific terms of each opportunity (term, target return, guarantees), you authorize Guía Transparente S.A. to manage the funds as agreed, you acknowledge that the investment is not a bank deposit and is not guaranteed.
5. Fees and expenses
Guía Transparente S.A. charges: 2% management fee on invested capital, 10% success fee on generated profits. All fees are detailed in each opportunity before investing. No hidden costs.
6. Intellectual property
All content on the Platform, including text, graphics, logos, icons, and software, is the property of Guía Transparente S.A. or its licensors and is protected by Argentine and international intellectual property laws.
7. Limitation of liability
Guía Transparente S.A. acts as an intermediary between investors and developers. We do not guarantee the success of any project or the recovery of invested capital. Our liability is limited to the proper functioning of the Platform and compliance with applicable regulations.
8. Dispute resolution
Any controversy shall be submitted to the ordinary courts of the Autonomous City of Buenos Aires, Argentine Republic, waiving any other jurisdiction that may correspond.
9. Modifications
We reserve the right to modify these Terms at any time. Changes will take effect upon publication on the Platform. Your continued use implies acceptance of the modifications.
